Planning permission or Building Regulations: what is the difference?

Two of the most common questions at the start of a project are whether you need planning permission and whether you need Building Regulations approval. They are separate systems, and getting one does not mean you have the other.

Planning permission

Planning permission is about whether the work is acceptable in its setting. Your local planning authority looks at things such as how the building will look, its size and position, and the effect on neighbours and the area. Some work is allowed without an application under permitted development rights.

Building Regulations

Building Regulations are about whether the work is safe and performs properly. They cover subjects such as structure, fire safety, ventilation, drainage, insulation, and safe access and escape. Most extensions, loft conversions and structural alterations need Building Regulations approval, whether or not they need planning permission.

  • Planning permission asks: should this be built here, and how should it look?
  • Building Regulations ask: will it be built safely and to the required standards?
  • Planning decisions are made by the local planning authority.
  • Building Regulations approval comes from the council’s building control service or an approved private inspector.

  • A party wall notice, if the work affects a wall you share with a neighbour or is close to their building.
  • Listed building consent, for listed properties.
  • Rules that apply in conservation areas.
  • Freeholder or landlord permission, if you own a leasehold property.
